Terms, conditions & privacy

The following Terms and Conditions refer to the activities from The Healing Hands Center, established in Nepal, & Yoga Touch Therapies, in the Netherlands. Yoga Touch Therapies is the main organizer of the courses and works in collaboration with The Healing Hands Center.

Our Terms and Conditions are applicable for all types of workshops, classes and courses that we offer. The terms ‘you’ or ‘your’ refer to the person whose name is listed on the enrolment form. By completing the Enrolment Form, you agree that the Enrolment Form together with these Terms and Conditions form a contract between you and The Healing Hands Center and Yoga Touch Therapies.

After registration you receive a confirmation and an invoice with the indebted sum. The sum needs to be paid within the term of payment. After receiving the payment we send a confirmation together with extra information that is relevant for the workshop, class or course you have chosen.

Participants are arranged based on the date we receive the registration form. In case of overbooking candidates are put on a waiting list. If a place becomes available people on the waiting list are contacted in order of application.

1. Payment

1.1 You must pay to Yoga Touch Therapies the amounts agreed upon for the workshop, class or course as outlined in pricing and payment in the agreed time frames.

1.2 If payments are not made by due dates, your course enrolment can be cancelled, and no refund or credit will be given.

2. Cancellation

If, due to circumstances, you are not able to join the workshop, class or course, you need to let us know in writing. In case of cancellation by the registered student (or in his/her name) a certain cost is charged. The date we receive the written cancellation is considered as the date of cancellation.

2.1 In case of cancellation up to 30 days before the planned starting date a payment of 21% of the total netto price is charged.

2.2 Up to 10 days before the planned starting date 50% of the total netto price needs to be paid.

2.3 In case of cancellation within 10 days before the starting date restitution is no longer possible.

2.4 Course enrolments are not transferable to a different product or service or another person.

2.5 All requests for refunds must be made in writing to thehealinghandscentertour@gmail.com.

2.6 The Healing Hands Center / Yoga Touch Therapies is entitled to postpone or cancel a workshop, class or course in case there are not enough registrations or due to unexpected circumstances. In case of changes like this participants receive a written notice in advance.

When booking a flight, a cancellation insurance is recommended since an event can bepostponed or cancelled in particular circumstances.

3. Online workshops, classes & courses

3.1 Upon commencement of the course we will email you the access link to the online learning platform.

3.2 If technical issues arise, we will re-schedule any of these items as required.

3.3 Recorded items will only be delivered if this options is provided within the course.

4. Limitation of liability

4.1 I understand that the workshops, classes and courses are not a substitute for medical attention, examination, diagnosis or treatment. My enrolment affirms that a licensed physician has verified my physical, emotional and mental health is suitable to participate in the specific workshop, class or course, if required. In addition, I will notify The Healing Hands Center / Yoga Touch Therapies of any medical conditions or physical, emotional or mental limitations before attending any of their workshops, classes or courses.

4.2 The Healing Hands Center / Yoga Touch Therapies are not responsible for theft, lost goods or accidents during the workshops, classes and courses.

5. Intellectual property rights & terms of use

5.1 All concepts, information and materials in the workshops, classes and courses are the property of The Healing Hands Center and Yoga Touch Therapies. The Healing Hands Center and Yoga Touch Therapies shall have sole title and ownership of all Intellectual Property Rights in the Materials or Recordings or created in the provision of any of its services. Whereby, “Intellectual Property Rights” means patents, trademarks, copyrights, database rights, design rights, applications for registration of any of the foregoing and all rights of like nature arising or subsisting whether registered or unregistered;

5.2 In delivering the workshop, class or course for you, we do not transfer title to you of any intellectual property and title to all such intellectual property remains with us.

5.3 You acknowledge and agree that you have no right to modify, edit, alter or enhance any of the Materials in any manner. Furthermore, you will not pass off the content, concepts or information in the Materials as your own.

6. Communication services

6.1 The workshops, classes and courses contain areas for comments, messages, discussion, live Zoom sessions and/or other communication facilities designed to enable you to communicate with the group at large as well as the facilitators (collectively, ‘Communication Services’).
The opinions expressed through the Communication Services are solely the opinions of the participant, and do not reflect the opinions of The Healing Hands Center / Yoga Touch Therapies.
The Healing Hands Center / Yoga Touch Therapies has no obligation to monitor any of the comments or postings made by participants on the course platform. However, you acknowledge and agree that we have absolute right to monitor the same at our sole discretion.
In addition, we reserve the right to alter, edit, refuse to post or remove any postings or content, in whole or in part, for any reason and to disclose such materials and the circumstances surrounding their transmission to any third party in order to satisfy any applicable law, regulation, legal process or governmental request and to protect ourselves, and our clients.

You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not: defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others; publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information; upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents; upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer; advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages; conduct or forward surveys, contests, pyramid schemes or chain letters; download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner; falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded, restrict or inhibit any other user from using and enjoying the Communication Services; violate any code of conduct or other guidelines which may be applicable for any particular Communication Service; harvest or otherwise collect information about others, including e-mail addresses, without their consent; violate any applicable laws or regulations.
Always use caution when giving out any personally identifying information about yourself in any Communication Service. The Healing Hands Center and Yoga Touch Therapies do not control or endorse the content, messages or information found in any Communication Service and, therefore, The Healing Hands Center and Yoga Touch Therapies specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service.

7. Changes to terms & conditions

7.1 The Healing Hands Center and Yoga Touch Therapies reserves the right, in its sole discretion, to change the Terms & Conditions. The most current version of the Terms & Conditions will supersede all previous versions. The Healing Hands Center and Yoga Touch Therapies encourages you to periodically review the Terms & Conditions to stay informed of our updates.

8. Privacy statement The Healing Hands Center / Yoga Touch Therapies

The Healing Hands Center and Yoga Touch Therapies organizes activities and sends newsletters from two pillars:

It goes without saying that The Healing Hands Center and Yoga Touch Therapies respect the relevant privacy legislation. What this means in concrete terms can be found below:

8.1 We only collect personal data that you provide to us yourself by subscribing to our newsletter, our e-zine, free giveaways or by participating in our activity offer.

8.2 We only collect data that are important for the activity and / or for creating invoices. This also concerns data that we could receive directly from you. We also keep track of how you have given us that information and where you have given permission to receive things from us such as the newsletter, giveaway, ezine, etc.

8.3 Your data will only be used in function of the service you have requested and the services for which you have given permission. We never pass on your contact details to third parties for commercial purposes

8.4 Your data will be kept until you log out or request us to delete that data. As long as you do not do this, we will keep you informed of our activities.

8.5 Your data is treated securely. That is why we use various security measures to appropriately protect your data against unauthorized access, use, loss or disclosure. These measures are tested at regular intervals and adjusted if necessary.
